How many days overdue before you can issue a notice to vacate in Victoria

In Victoria, a landlord can give a notice to vacate for unpaid rent once the renter is 14 days behind. Counting those days correctly is where people go wrong, so here is a worked example.
The rule in one line
Consumer Affairs Victoria says that if a renter is more than 14 days late on rent, the rental provider can give a notice to vacate. Tenants Victoria describes it as 14 days or more of unpaid rent. The two wordings differ by a day, which is why we count cautiously and why you should check with the source if the day matters.
A worked example
Rent is $2,000 a month, due on Saturday 1 August 2026, and nothing has been paid.
- Saturday 1 August: rent falls due. It is not overdue yet.
- Sunday 2 August: day 1 overdue.
- Saturday 8 August: day 7 overdue.
- Friday 14 August: day 13 overdue.
- Saturday 15 August: day 14 overdue. This is the first day the 14-day test is met on our count.

What part payments do
A part payment reduces the amount owing. It does not restart the count on its own, because the rent is still not fully paid. Our guide to part payments has a worked example. If the renter pays enough to clear the oldest rent, the count starts again from the next rent that is unpaid. Always keep the date and amount of each payment.
After the 14 days
Reaching 14 days does not mean you have to give a notice. It means you can. The notice must allow at least 14 days before the renter has to leave. You can give it by hand, by registered post, or by email if the renter has agreed. See the official page for the current requirements.
